A bayside cafe owner has faced court after her chaotic outburst where she kicked and threw her boots at a police officer before slapping him in the face knocking his glasses off.

Redland Bay resident, Holly Macnamara, 44, pleaded guilty in Cleveland Magistrates Court on Tuesday, October 25, to one count of assaulting a police officer, committing a public nuisance, obstructing a police officer and wilful damage of police property.

The court heard that on September 17 at the Sands Hotel in Cleveland, the Redland Bay cafe was intoxicated and exiting the hotel with two staff members.

“She was slurring her words and unsteady on her feet,” the police prosecutor said.

“Police officers offered to drive her home but she said she would walk.”

The court heard Macnamara was obstructing a thoroughfare to the hotel and she was arrested as a result.

“The defendant began kicking the pod door (in the police van),” the police prosecutor said.

“She took off her boots and swung them at the doors and walls.

“The police officer opened the door and told her to put her hands behind her back to be restrained.

“She kicked him before slapping him in the face knocking his spectacles off.”

Macnamara’s lawyer, Bruce Johnstone, said his client was remorseful.

“She’s extremely embarrassed,” Mr Johnstone said.

“She has never done anything like this before.

“She can’t even remember having dinner but she can remember having two champagnes.

“She’s a hard working upstanding member of the community,”

Magistrate Deborah Vasta warned Macnamara of the effects of alcohol.

“You’ve got to watch your drinks,” Ms Vasta said.

“There’s nothing like waking up in a hospital and then coming to court listening to what you did that night.”

Macnamara was ordered to pay $200 in restitution for damaging the police car and $400 to the police officer who was harmed.

She was put on a good behaviour bond of $500 for 15 months.

Convictions were not recorded.
