An expecting father from Brisbane’s southside has been told by a magistrate “there are no rabbits” she can pull out of a hat to save him from jail if he offends again.

Mt Gravatt East’s Sebastian Giuffrida, 28, pleaded guilty in Cleveland Magistrates Court on Tuesday, December 20, to one count of evading police.

The court heard Giuffrida was intercepted by police on Redland Bay Rd in Alexandra Hills on April 5 this year.

The sentence was partly heard on a previous date.

“Last time we spoke I was prepared to send you to two months jail,” Magistrate Deborah Vasta said.

“I wasn't prepared to let you walk out that door.

“You have an awful criminal and traffic history.

“I gave you one last chance to put your money where your mouth is.”

Ms Vasta said Giuffrida’s behaviour on the night of the offence was appalling.

“You’re only charged with not stopping for police, where you could have been charged with disqualified driving or dangerous driving,” she said.

“You had not given me anything at the bottom of the barrel to scrape.

“There’s no more rabbits I can pull out of hats to save you from jail.”

Ms Vasta said Giuffrida was partaking in an opioid rehabilitation program and was expecting his first child.

“If there’s any time to rehabilitate it is now,” Ms Vasta said.

“I’m not sure if I’m going to regret this decision and call this bluff.”

Giuffrida was convicted and fined $7187.50 and was disqualified from driving for two years.

Convictions were recorded.
