A Bayside man has walked free from court telling a magistrate he would not hurt his partner again despite headbutting her in the face and screaming foul abuse at her.

A bayside man has walked free from court after headbutting his partner in an abusive attack and calling her names.

The Macleay Island man pleaded guilty in Cleveland Magistrates Court on Tuesday, August 16, to one count of breaching a domestic violence protection order.

The court heard the 42-year-old man, who cannot be named, was driving home from a tavern on Lamb Island with his girlfriend of two weeks on June 24 when an argument unfolded between the pair.

“You’re a f**king s**t, no one likes you you’re a whore,” police prosecutor Constable Agresta quoted the man as saying.

They were outside his girlfriend’s home when he attacked her, the court heard.

“He headbutted the aggrieved,” Constable Agresta said.

“He left yelling you s**t, wh**e.”

Later two text messages were sent calling the woman a “s**t”.

The 42-year-old, who represented himself, said he would not hurt her again.

“I didn’t hit her or nothing, I love the woman,” he said.

“I won’t hurt her your honour, I cross my heart and hope to die.”

Magistrate Deborah Vasta said the best way to assist him would be to monitor his behaviour.

“The best way to help everyone is to put you on a 12 months’ probation order,” Ms Vasta said.

Convictions were recorded.
