Cleveland man denied bail on alleged assault on 73-year-old woman

A bayside cleaner has been denied bail after allegedly bashing his ex-partner and her 73-year-old mother, with a magistrate fearful he may go back to the house and kill them if released.

A bayside man has been denied bail following a magistrate’s concerns he might kill his ex-partner and her mother.

The Cleveland cleaner, 43, appeared in Cleveland Magistrates Court today, September 26, charged with one count of assault occasioning bodily harm, one count of a serious assault of a person over 60 years old and one count of wilful damage.

The court heard the man was at a Cleveland home on September 24 this year when he allegedly became angry, yelling at his ex-partner.

“He’s punched the aggrieved in the face,” a police prosecutor said.

“(He’s) continued trying to punch the aggrieved and (a) witness has received some of that in the crossfire.”

The man’s mother-in-law has tried to intervene, before allegedly being struck herself, the court heard.

“She has come out of the bedroom and seen the defendant,” police prosecution said.

“Without warning (he) has just punched her.

“He’s continued to kick her, that’s when the dog became involved and accidentally bit her leg.”

The court heard the 73-year-old alleged victim required ambulance treatment.

“He’s continued kicking and punching walls, pushed the television off the stand,” prosecution alleged.

“He was clearly affected by alcohol.”

Magistrate Deborah Vasta said she was concerned what he would do if released on bail.

“The concern is he’ll get out go back to that house and kill them,” Ms Vasta said.

“What if he does get out?

“I’m not prepared to run that risk.”

He was denied bail and is due to appear in Cleveland Magistrates Court on November 24.
