A bayside man has faced court after a drunken decision to reach through the window of a parked car and steal a packet containing a landline phone.

Capalaba resident, Daniel Kenneth Smith, pleaded guilty in Cleveland Magistrates Court on Tuesday (August 9) to one count of entering a premise and committing an indictable offence.

The court heard the 47-year-old was at a local tavern on March 24 this year when he reached into a car parked in the carpark.

“He approached the victim’s vehicle, reached through the window that was open and took a new package of landline phones, put them in a shopping bag and walked away from the tavern,” police prosecutor Sergeant Duncan Blackburn said.

CCTV footage captured Smith taking the phones, valued at $110.

Sergeant Blackburn said Smith gave no valid reason for being inside the car.

Hi Lawyer, Tania Lacy, said her client had ongoing mental health issues.

“His mental health was not good at the time,” Ms Lacy said.

“He had taken heroin at the time and was also heavily intoxicated at the time and he can’t remembering the offending.”

Magistrate Deborah Vasta said his behaviour was not acceptable.

“Someone with your history can’t afford a spur of the moment offence,” Ms Vasta said.

“Someone with your history should know better.”

Smith was convicted and ordered to serve 60 hours of community service within 12 months.
