A Capalaba man was remanded in custody yesterday on Ice supply charges in a surprise development when the court realised he was already on Supreme Court bail for other offences.

Appearing at the Cleveland Magistrates Court on Thursday Joseph James Kelly, 43, was summarily locked up during his hearing in a move that surprised both Kelly and his former defence lawyer, Bruce Johnston.
Mr Johnston told the court he would no longer represent Kelly.
The court heard Kelly faced serious drug charges, some of which would have to be moved to a higher court.
Kelly was alleged to have been in possession of excessive methamphetamine on May 25; to have supplied methamphetamine on May 23 and to have driven while disqualified on June 25.
“You see Mr Kelly you’re on Supreme Court bail and there are allegations that while on Supreme Court bail you are still supplying methamphetamine and you allegedly had possession of an excessive amount of methamphetamine,” Magistrate Deborah Vasta said.
“Now a magistrate can’t deal with these matters; they have to go up to the Supreme Court.
“But the very fact that you are on that bail and you are allegedly committing more offences means you are on what is called a show-cause position.
“So I think you will continue to (allegedly) offend.”
According to court documents a remanded Kelly appeared for the matter at Cleveland Magistrates Court again on Friday and had his case adjourned to October 15 at the same facility.
