Australia's Court System

A paranoid schizophrenic man attacked two of his mates, breaking one of their noses and loosening his teeth.

On Tuesday, February 11, Mark Ian Kelsey drove his motorised scooted past an Everton Hills address where two of his friends were outside.

A court heard they waved at him, and Kelsey gave them the middle finger and yelled at one of them he was going to kill him.

He turned his scooter around, mounted the kerb and drove at the two men.

The court heard Kelsey, 56, punched a 63-year-old man, who he had threatened to kill, in the head then turned on the other man and punched him in the nose.

Kelsey punched the second man repeatedly in the head, knocking the man’s glasses off and damaging them.

The man fell to the ground and hit his head on a metal pole. Kelsey began kicking the man on the ground who tried to use the pole to avoid Kelsey’s attacks.

The two men eventually restrained Kelsey who calmed down and got back on his scooter and left.

The second man suffered a broken nose, damage to his teeth, bruising over his body and his glasses were damaged.

Kelsey pleaded guilty at Pine Rivers Magistrates Court to serious assault and assault occasioning bodily harm.

The court heard Kelsey had been diagnosed with paranoid schizophrenia in his 40s that had cost him his marriage.

Magistrate Trevor Morgan said although Kelsey’s mental health problems were not his fault, he had a responsibility to care for himself.

“The attacks on these blokes was horrible,” Mr Morgan said.

“They were your mates. What you believed at the time is that they were out to get you.

“It was due to your illness, but the community would be outraged if they thought you could be entirely forgiven for that.”

Kelsey was jailed for six months, suspended for two years. He was ordered to pay $325 in restitution for the damaged glasses.
