The court heard the 32-year-old was drunk at his family home in Kallangur when he attacked his wife, causing minor injuries to her face and body and cuts to her elbows.

“He punched her five times. Slapped, pushed, grabbed and struck her throat and head,” The police prosecutor said.

Pepe’s lawyer commented on the state he was in when the attack unfolded.

“He had consumed three bottles of vodka and consequently has no memory of the attack,” he said.

“When it was brought to his attention what he had done he was horrified”.

Magistrate Murphy commented on the level of ‘violence’ involved in the attack.

“What concerns me most is that this is certainly a case of actual physical violence to your partner,“ Mr Murphy said.

Pepe was convicted and received three months imprisonment, wholly suspended for 18 months.

“We want to rehabilitate you, we want you not to come back here. But that’s all up to you, you are the controlling factor,” Magistrate Murphy said.

“The ball’s in your court now”.
