Brothers cop prison sentence for shocking attack outside popular Sandgate pub

Patrons of the Mr Henderson bar witnessed the victim viscously attacked by his new-found ‘friends’ in the Aldi car park.

A north Brisbane pub goer got more than he bargained for when a friendly chat among strangers turned into a chaotic evening of violence, the Sandgate Magistrates Court heard on Wednesday.

Victim Xavier Daniel Duffy, 32, befriended brothers and co-defendants Jayden and Koddy Ryan Hargreaves, 29, at the Full Moon Bar at around midday on Saturday, February 29, 2020.

By all accounts, all three were already heavily intoxicated.

Duffy offered the pair a room to rent at his home, which was walking distance from the pub, and they followed him there to continue their chat over some beers.

According to the police prosecution, Koddy soon “became argumentative for reasons unknown” and, in an effort to diffuse the situation, Duffy suggested they relocate to the Mr Henderson bar on Brighton Rd.

Tension between the trio, however, continued to rise.

“It became very evident they didn’t really get along with each other,” said defence lawyer Rhys Foster from KLM Solicitors.

After another verbal altercation, Duffy waited for the brothers to go to the bathroom and then tried to sneak back home without them.

He didn’t make it far.

“(The brothers) ran over to the house and assaulted him as he tried to get inside,” said the prosecution.

“They grabbed his neck, elbowed his face, kneed him in the thigh and slapped him across the face.”

Duffy made a run for it, out the back door and into the carpark of the nearby Aldi, where multiple witnesses watching from the bar saw Jayden punch Duffy in the face.

The victim suffered significant bruising to his head and thigh which required hospitalisation.

A doctor’s report tendered to the court also noted the victim had difficulties swallowing following the attack.

While the victim lay wounded in the Aldi car park the brothers returned to his home to take a carton of beer and to smash his coffee table.

Both Jayden and Koddy pleaded guilty to assault occasioning bodily harm while armed or in company and entering a dwelling to commit an indictable offence.

Magistrate Jennifer Batts sentenced him to 12 months probation for the enter dwelling and nine months imprisonment for the assault, wholly suspended for 18 months.

Jayden, who appeared later in the day on a number of other unrelated charges, was ordered to pay $450 compensation to the victim and on these two charges sentenced to seven months imprisonment with immediate parole.

Convictions were recorded for both brothers.
