Brisbane man caught on camera throwing his partner to the ground and kicking her escapes jail time

A man who threw his partner to the ground and kicked her repeatedly has faced court where his acts were labelled as “disgusting and cowardly”.

A man threw a woman to the ground and repeatedly kicked her before later pushing her and causing injury, a court has heard.

The man appeared via video link at the Sandgate Magistrates Court charged with three counts of contravention of a domestic violence order.

The 38-year-old Brisbane man pleaded guilty to all counts.

Police prosecutor Sergeant Duncan Blackburn told the court the defendant breached an order of protection made in August on three separate occasions in October and November.

The court heard the first incident took place on October 27 at 3.50pm at Zillmere.

“There was a witness who captured video of the aggrieved and defendant having a verbal altercation,” he said.

“Police viewed the video and it would appear that during the altercation the defendant has embraced her … thrown her to the ground and proceeded to kick her a number of times.”

The court heard Police attempted to locate the man but were unable.

Sgt Blackburn told the court the second charge related to another incident that same day, at around 9.10pm.

“The defendant returned to the aggrieved house and there’s been another altercation,” he said.

“During this the aggrieved has been pushed by the defendant while she was trying to walk past him into the dwelling.

“As a result of the push, she has fallen face first on the staircase, resulting in a large cut on her forehead.”

The court was told the woman was taken to hospital to treat her injuries.

The man was then located at the Zillmere home again on November 1 when police attended the residence.

“(Officers) knocked on the door and he answered it and he offered no excuse for being at the address,” Sgt Blackburn said.

“He told police he did remember having the altercations … he claimed the aggrieved lost her footing when walking up the stairs and denied pushing her.”

The police prosecutor told the court the first two breaches were aggravated with actual violence committed against the woman.

“The second one was in the presence of a small child as well,” Sgt Blackburn said.

“In relation to the first incident, it’s a disgraceful, cowardly act to not only throw (someone) to the ground to then lay the boot in as well.

“It’s never acceptable.

“Prosecution asks the court to take into account the absolute stain of domestic violence on our community has a far reaching impact.

“The defendant’s behaviour was despicable.”

The man’s lawyer, Rhys Foster from KLM solicitors, told the court his client’s behaviour was “out of character”.

He told the court the man had been dealing with anger management issues over the past 18 months.

He previously worked as an auto electrician before losing his job due to the pandemic.

“He’s remorseful, he says he wishes he could take it all back,” Mr Foster said.

Magistrate Jennifer Batts said the matters before the court were very concerning.

“Especially the two of them that do involve physical violence and in the presence of a child,” she said.

The man was convicted and sentenced to 2 months imprisonment, wholly suspended for 12 months.

He was also placed on two years probation.
