A Kilcoy man kicked out the Eatons Hill Hotel took a swing at police when he wouldn’t get out of his lover’s Uber.
Clint Graeme Heron, 29, pleaded guilty in Pine Rivers Magistrates Court today to assaulting police at a licensed premises on December 12 last year.
The court heard Heron had been kicked out of the hotel by security and was outside when he saw a woman climb into an Uber.
Heron jumped in the back seat however according to the prosecution he was an “unwelcome intruder”.
When he was removed from the car by police, Heron swung a punch at one of the officers.
The court heard Heron, a payroll services officer at Queensland Health, had an on-off intimate relationship with the woman in the car, who was also his colleague.
Defence lawyer Brendan Beavon said Heron had also been struck in the jaw during the melee.
While the magistrate said Heron’s actions were serious “it’s clear that you are otherwise of good character”.
“This is an aberration for you, however the police are there to do a job.
“You weren’t welcome in that Uber.
“You then attempted to punch a police officer who was just going about their duties.
“I will send a message that (emergency service workers) will be protected by the courts... those who choose to assault or resist will be dealt with sternly.”
However the magistrate said the matter was not something “that should affect your future”.
Heron was fined $400 and had no conviction recorded.
