Christopher Paul Johnstone: Night out at Eatons Hill Hotel ends in capsicum spray

A 28-year-old man has appeared before court after a night out ended in the back of a police car covered in capsicum spray.

A night out at the pub has ended in court for a Brisbane reveller who refused to leave the Eatons Hill Hotel.

Warner man Stephen Paul Johnstone, 28, appeared before the Pine Rivers Magistrates Court on a single charge of obstructing a police officer (licensed premises).

The 28-year-old pleaded guilty as he stood before Acting Magistrate Patrick Murphy.

The court heard Johnstone had no relevant criminal history prior to his outburst on August 28 this year.

Police prosecutor Sergeant Graham Turner told the court security ordered Johnstone to leave the South Pine Rd tavern about 1.00am.

“The defendant was given advice by security staff in regards to some actions he was doing … security then removed him and brought him to police,” Sgt Turner said.

The court was told officers attempted to take Johnstone towards their vehicle to conduct a search, it was then Johnstone reacted.

Sgt Turner told the court Johnstone tried to leave the scene and walk away from police several times during their interaction.

“Johnstone broke free from police and grabbed an officer’s arm … and refused to let go,” Sgt Turner said.

“He was told multiple times to let go and he refused.

“He continued to push police and two security guards assisting them.

“He was informed he would be sprayed with OC spray if he continued.

“He was warned three times before he was sprayed and detained by the officers.”

Johnstone’s lawyers told the court he suffered from Tourette’s, borderline personality disorder and OCD.

“Your Honour can see he’s got some pretty serious medical conditions,” he said.

“His GP does indicate that his OCD may have played a part in the offending.”

Mr Murphy told Johnstone he took into account his early plea and the circumstances regarding the offence.

He was convicted and fined him $250.
