Brett Avery jailed for break-in, cruising in stolen Porsche

A “stupid” criminal who stole from a dead person and went on a cruise in a stolen Porsche will stay in jail until next year.

A refrigeration mechanic who didn’t bat an eyelid when his friend rocked up in an stolen $80,000 Porsche will stay in prison until 2021.

Brett Michael Avery was slammed by a Caboolture magistrate as “just stupid” after he was nabbed by police for a string of offences including unlawfully using the luxury car and breaking and entering.

The court heard Avery’s friend picked him up in the Porsche Carrera near Elimbah north of Brisbane, and while he wasn’t the driver, Avery — who had served a previous 30-month sentence for unlawful use of a motor vehicle — would have known the car was stolen.

Magistrate James Blanch also heard Avery stole sporting memorabilia and motorbikes from a home during break-in and that Avery had described the offence as a mistake.

“Forgetting your mother’s groceries on the way home is a mistake... breaking an entering is not a mistake,” the magistrate said.

“He’s an experienced criminal... he’s just stupid.

“I’ve had a look at his history... which is appalling for offences of dishonesty and drug matters.”

The court heard Avery had previously been dealt with on three counts of entering premises, eight charges of unlawfully using a motor vehicle and 17 counts of fraud.

“(It was) a deceased person’s house and you took items,” the magistrate said of one of Avery’s break-and-enter offences.

“You broke a padlock to get in — it’s disgraceful.

“You’re not a criminal master mind... even on fleeing the two cars ran into each other... it could be a comedy.”

Avery pleaded guilty to entering a dwelling and committing an indictable offence, entering a premises and committing an indictable offence and unlawfully using a motor vehicle.

He was sentenced to 36 months’ imprisonment for each charge, and will be eligible for parole on February 7.

A further suspended sentence, which he had breached by committing these offences, was also extended for 12 months.
