A bus driver has rescued a 75-year-old man after he was roundhouse-kicked to the head and showered in punches by a fellow traveller.
The elderly man had told 33-year-old Brendan Gerrard Barlow not to smoke in a public area at Caboolture Train Station when the abuse erupted, Caboolture Magistrates Court heard.
As the disagreement intensified, Barlow quickly approached the seated elderly man and struck him in the head with a roundhouse-style kick.
The court heard Barlow then showered the man in quick jabs to the head.
He was left with a blackened eye, a cut lip and bruising to his head.
“The defendant flipped his switch over very little,” said Magistrate Andrew Hackett, who described Barlow’s punches on the man as “fast and forceful blows to the head”.
“The full blow of your kick was administered to his head,” Magistrate Hackett said.
“You came at him with speed (and) he was ill equipped (to escape) because of his age.
“I note a bus driver had to get involved.
“He needs to have some recognition of his efforts.”
Barlow, who the court heard had not been taking his prescribed medication at the time, pleaded guilty to serious assault of a person over the age of 60.
He was sentenced to 10 months jail, suspended after serving three months with the suspension lasting two years.
He will be eligible for parole in about 45 days, having already served 45 days in custody before sentence.
