A terminally ill patient at a Brisbane hospital has narrowly avoided jail after kicking a nurse in the head.
Strathpine man Ashley Brent Ledez, 40, was receiving treatment for a terminal kidney disease at the Royal Brisbane and Women’s Hospital on January 25 when he violently lashed out at a nurse who was trying to help him.
Pine Rivers Magistrates Court heard Ledez was semi-conscious while the nurse held some gauze on his bleeding leg.
The court heard Ledez lashed out and kicked her in the head after she tried to get his attention by saying his name.
“You just assaulted me, are you kidding me?” the nurse said, the court heard.
“The kick didn’t even get you,” Ledez replied.
Magistrate Trevor Morgan said Ledez had appeared before him on numerous occasions and had run out of sympathy, despite his terminal diagnosis.
“You’ve made sure the community has no sympathy for you whatsoever, because you’re an anti-social type and you’ve made a pest of yourself.”
The court heard the nurse had continued to treat Ledez, who receives multiple dialysis procedures a week, even after the assault.
“It’s a credit to her that she continues to supply services to you.”
Ledez pleaded guilty to serious assault of a public officer performing a function, as well as one count of driving under the influence of liquor from a separate offence.
He was sentenced to three months jail with immediate parole, ordered to pay the nurse $1000 in compensation, which was paid on the spot, and fined $1000 and disqualified from driving for 18 months for the drink driving offence.
