Man’s jaw smashed in two places in alleged road rage punch

A man taunted a motorist for ‘cowardice’ after punching his victim so hard he needed plates inserted in his jaw.

A man accused of viciously punched another motorist in a road rage incident at Mt Cotton went back to taunt his victim as he cowered on the ground, a court has heard.

Jordan Michael Hamill, 25, was on probation at the time for punching a passenger on the Russell Island ferry in October last year, a Cleveland Magistrates Court bail hearing has been told.

The court heard Hamill was driving a stolen Toyota LandCruiser and was unlicensed and veering erratically over the road just before the April 29 attack, forcing his victim to brake.

Hamill also stopped and mobile phone footage taken by a passenger in the victim’s car showed Hamill kicking the car door and shouting at the victim.

The punch was so hard it broke the victim’s jaw in two places, requiring surgery at Princess Alexandra Hospital where doctors had to insert metal plates.

Two wisdom teeth had to be extracted and another tooth was cracked.

The police prosecutor told the court the victim was on the ground, holding his jaw and trying to shield his face, as Hamill stood over him and called him a coward for not fighting.

“The defendant is an unacceptable risk to the community. He was on 18 months’ probation at the time.

“He clearly has anger problems; his behaviour is erratic. He definitely should be in custody.’’

The prosecutor said on October 19 last year Hamill followed a passenger who was on the ferry from Russell Island, punching them on the side of the face after they walked off the jetty.

“He fell to the ground then he (Hamill) hit him again,’’ the prosecutor said.

“He grabbed a mobile phone from the victim’s pocket when he was lying on the ground and smashed it hard into the ground.

“They say three strikes and you’re out. This is two strikes.

Hamill, who appeared via telephone link, said he was provoked by the ferry passenger and claimed they were drunk and had previously reported Hamill to the police for no reason.

“Yes, I’m an angry person, but it’s due to drugs.’’

Hamill’s defence lawyer said her client had no previous breaches of bail or failures to appear in court, he had no idea where the road rage witness lived and so could not interfere with them.

Although born in New Zealand, Hamill had no current passport, would agree to stay away from airports and consent to wearing a tracking bracelet.

But Magistrate Deborah Vasta refused bail, saying the victim was lucky not to have died.

She also noted Hamill had never sought drug rehabilitation or any other counselling.

“At this stage, you’re too dangerous to be out there (at large). I think you’re an unacceptable risk of killing somebody,’’ she said.

Ms Vasta remanded Hamill in custody until July 9 for a committal mention in the Brisbane District Court.
