Yok Tan jailed for one month after tragic Meadowbrook death of motorcyclist Jason Bennett

The grieving partner of a man killed in a Logan motorcycle crash has revealed her pain after a series of fatal decisions that led to the man’s death were detailed in court.

The partner of a Loganlea motorcycle rider killed when he was struck by a car has revealed her pain following the sentence of the driver involved, the day before what would have been the father's 50th birthday.

Sixty-eight-year-old Yok Tan pleaded guilty in Beenleigh Magistrates Court to driving without due care or attention causing the death of Jason Paul Bennett.

The court heard that on May 24, 2021, Tan was driving on Ellerslie road, Meadowbrook and turned right at a green light as she hit the oncoming 48-year-old Loganlea motorcyclist Mr Bennett.

Tan was supposed to give way to the motorcyclist but turned into his path.

Magistrate Patrina Clohessy said while she did not want to cause any anguish to Mr Bennett’s family, investigations had found he had no motorcycle license, was disqualified from driving and had a blood alcohol reading of 0.117 per cent at the time of the crash.

He was also travelling between 111 km/h to 128 km/h in a 50 zone.

Mr Bennett‘s grieving family would have celebrated his 50th birthday on Wednesday, October 12 and former partner Amanda Ross said the past year without him had been stressful.

“His 50th birthday should have been a joyful time but instead it is sad – we were going to try IVF,” she said.

“I tried to stop Jason from taking the bike that day but he just jumped on and took off.”

Tan was sentenced to one month in prison, suspended, was disqualified for 9 months from driving and a conviction was recorded.

“I was expecting the driver to get more jail time but it is what it is,” said Ms Ross.

“She (Tan) said she did not hear Jason‘s motorbike coming down the street and she pulled out and hit him and he died at the scene.”

The court heard Tan had completed the Queensland Traffic Offenders Program and she told the court not a day goes by that she does not think about the crash.

She grew up in Singapore and has been married for 48 years and has two children to her husband.

Her husband and daughter supported her in court during the sentence.

The court heard Tan had genuine remorse for her part in the tragedy.

Magistrate Clohessy said Tan lived a law abiding and productive life.

“I accept there hasn’t been a day has passed where this incident has not had an impact on you,” she said.

“You turned into the path of an oncoming motorcyclist and were careless in that you failed to give way or pay reasonable care and attention in the path of oncoming traffic.”

Ms Clohessy said the tragedy was the impact Mr Bennett’s loss will have on his loved ones.

“The tragedy is the victim was a loved father and will forever be missed by his family and friends.”

Along with his partner Ms Ross, Mr Bennett leaves behind his son Steven, 31, and daughter Brittany Jade, 24, who both live in the Logan area.
