Neighbours had to rush to the aid of a six-month-old baby who was the centre of a tug-of-war between their fighting parents in Woodridge, a court has heard.
Police were called to a house in Woodridge early last Tuesday night, after residents reported a disturbance on the street.
Beenleigh Magistrates Court heard the couple was seen arguing over who the child should live with, before things escalated.
Magistrate Louise Shepherd heard the child’s father was seen trying to evade the 23-year-old woman, walking up the street with the six-month-old in his arms.
However the mother followed, trying to retrieve the child in the middle of the street before neighbours rushed to intervene.
Magistrate Shepherd said the woman was using the child “as a part of a tug-of-war”.
The court heard that a domestic violence protection order was in place at the time, preventing the mother from seeing her ex-partner who she was unlawfully living with.
Magistrate Louise Shepherd noted the seriousness of the breach of domestic violence order.
“They are not conditions that you comply with if you feel like it, they are the conditions.
“The fact that you have shown a real disdain for that is serious,” she said.
The woman pleaded guilty to two counts of contravention of a domestic violence order and one count of breach of bail conditions.
She was sentenced to one month jail, wholly suspended for six months.
Ms Shepherd said the couple “were both as bad as each other really,” for the actions in the presence of an infant child.
Convictions were recorded.
