A 23-year-old Eagleby timber yard worker who sped off from cops on his moped after a wild drunken night partying with friends admits he “stuffed up”, a court has heard.
Tony Bracken, 23, pleaded guilty in Beenleigh Magistrates Court on Thursday to mid-range drink driving and evading police.
The court heard police spotted Bracken driving a moped in an “uncontrolled manner” with two passengers on board while going down Third Ave, Berrimba just after 1am on August 21.
Police prosecutor Sergeant Darrel Armfield said an unmarked police vehicle behind the moped activated its lights and sirens, indicating for them to stop.
“The moped initially pulled to the left-hand side of the road, as if intending to stop and then failed to slow down,” he said.
“It continued to drive in the dirt on the side of the road, breaking the underside of the moped on the ground and causing sparks.”
He said the moped returned to the road and sped off but police later located the three males at a nearby dwelling.
Bracken made admissions to driving the moped and police noticed he smelt strongly of alcohol and was slurring his words.
Tests later revealed he had a breath alcohol content of 0.149 per cent.
Bracken’s lawyer told the court his client had been to a party earlier that night and was drunk.
“In his own words, he’s stuffed up,” he said.
“He does accept there’s going to be severe penalties arising out of this offending.”
He was fined $7,395 in total and disqualified from driving for two years.
