Marsden dad, Levi Hudson Gemmell, sentenced for wilful damage

A new dad has faced court after smashing in the glass at a Logan home to snatch a baby cot for his two-month-old child.

A Logan dad has faced court after breaking into a house to retrieve a baby cot.

Marsden resident, Levi Hudson Gemmell, 20, pleaded guilty in Beenleigh Magistrates Court on Wednesday (August 17) to one count of wilful damage.

The court heard the new dad broke into a Loganlea home, demanding the occupants give him a baby cot.

“He demanded that the resident retrieve a baby cot that was his and started kicking the glass sliding door, resulting in the glass shattering into shards,” police prosecutor Sergeant Karine Evans said.

“He had entered the dwelling and taken the cot.”

The home was next to the house where the parents of Gemmell’s partner lived.

Mr Gemmell’s lawyer, Jamiee-Lee Jessop, said her client was remorseful.

“He accepts responsibility for his actions,” Ms Jessop said.

“The offending occurred during chronic stress following a breakdown of a relationship with his partner who was pregnant at the time.”

Magistrate John Costanzo said Mr Gemmell committed the offence while on a nine months’ probation order for a previous charge of burglary.

“You’re not supposed to be back here,” Mr Costanzo said.

“Yet here you are committing a violent offence, how dare you.

It was criminal, it was violent, you lacked self control.

To say that you did this because of personal stress because of your relationship is no excuse at all.

You don’t respect the law.”

Mr Gemmell was fined $1800.

Convictions were not recorded.

“It’s time to grow up,” Mr Costanzo said.

“You’re 20, not 12.”
