Magistrate adjourns sentencing of defendant, says he is appalled by the case

A Queensland Magistrate has labelled a defendant’s treatment a travesty of justice, after the man’s ex-wife held a party when he was sent to jail.

A Queensland magistrate has labelled the treatment of a Jimboomba man by the legal system as a ‘travesty of justice’ and blamed the defendant’s offending on his ex-wife’s alleged infidelity.

Troy Matheson, 45, appeared in Beenleigh Magistrates Court while in custody, facing charges of common assault, wilful damage and breach of bail.

Matheson pleaded guilty to all charges but after Magistrate Ronald Kilner read the psychologist report, he refused to sentence the defendant and instead adjourned the matter, part-heard, until December 5.

“I wonder who should be in the dock, the aggrieved or Mr. Matheson,” said Magistrate Kilner.

“Quite frankly I think this is a travesty of justice, surely this is not what our system is about.

“His wife goes to cheat and break up a family, he tries to restore the family and is punished further.

“I am quite frankly appalled and I think it should be further investigated.”

The court heard the defendant’s ex-wife had a ‘Troy is in jail party’, when Matheson was sentenced earlier in the year.

Magistrate Kilner said he did not excuse Matheson’s actions but understood his reasons.

“I don’t condone the wilful damage but I think there may have been significant provocation.”

Matheson was granted bail and will appear again in Beenleigh Magistrates Court on December 5.
