Macayleigh Eve Shelton pleads guilty to riding with alcohol in system while on provisional licence

A former motocross racer has made her second court appearance in as many months after being caught with alcohol in her system.

Australia's Court System

A popular Logan tattooist and ex-motocross racer who caused a crash while riding unregistered was before court again this week for a new offence.

Last month Macayleigh Eve Shelton faced Beaudesert Magistrates Court, where she pleaded guilty to driving an unregistered and uninsured vehicle without the appropriate license, and without due care.

This week, the 22-year-old fronted Beaudesert Magistrates Court and pleaded guilty to driving with alcohol in her system while on her red P plates.

Magistrate Tracey Mossop fined Shelton, and disqualified her from driving or holding a license for three months.

It has previously been reported that the Beaudesert Magistrates Court heard Shelton used to be a motocross racer.

The court heard Shelton was suffering from her parents’ separation, had a limited traffic history, was working as a tattoo apprentice in Lutwyche, and was having trouble with her mental health.

Magistrate Tracy Mossop previously told the court the best thing for Shelton’s mental health would be to not commit offences, and to not have the stress of court appearances.

Just over a month later, and Shelton was hauled before court again with another traffic offence.

The court heard Shelton was driving with alcohol in her system on Saturday August 28, the weekend after her previous court appearance on Tuesday August 24.

Police prosecutor Senior Sergeant Andrew Bjerring told the court she was driving along Brisbane Street, Beaudesert, about 12.08am on Saturday August 28.

“The defendant was intercepted for a roadside breath test and a license check,” he said.

“The defendant produced a P1 drivers license.”

The court heard Shelton was driving home from the Albert and Logan Hotel on her red P plates, and had a reading of 0.039.

While under the regular limit for open licence holders, P platers are required to maintain a zero reading.

Shelton told the court she had made a mistake.

“With everything that’s been going on I’ve just been focused on my career path and have a very big dream of mine that I’m trying to achieve,” she told the court.

“I’m not a drinker.

“I never drink. It’s the first time I’ve ever gone out and had a drink.”

Ms Mossop told Shelton that if she is on a provisional license, she’s expected to not have any alcohol in her system.

“You’re on a zero limit,” she said.

Ms Mossop told the court if Shelton drives again in the next three months, she’ll be looking at a two year license disqualification.

Shelton was also fined $100. No conviction was recorded.
