An elderly retired police officer and decorated army veteran who served as captain has been attacked by a Logan father.

Beenleigh Magistrates Court heard on Thursday, July 20 that Levi Rulon Hilton went to grab a vehicle safety certificate from the 84-year-old veteran on January 18 last year in Waterford.

There was a dispute and the 35-year-old Auckland-born father grabbed the victim’s hand in the process which caused the victim to lose balance and fall over.

Hilton pleaded guilty to one count of common assault.

The court heard the elderly army veteran had reached the rank of captain after 10 years’ service in the military.

He was also a former police officer.

In a victim impact statement tendered to the court, the veteran said he had become withdrawn and scared since the attack.

Magistrate Cameron McKenzie said the victim’s age was a concerning factor in his sentencing decision.

Hilton was sentenced to three months prison, wholly suspended for nine months.

Hilton was sentenced last year in Southport District Court last year for assaulting two police officers in Labrador at a family barbecue.

Hilton received a nine month prison sentence and was immediately released on parole for that offending.
