A Goodna man violently pushed his ex-girlfriend and pinned her to the bed to the point where she felt like she couldn’t breathe after he was told to stop drinking, a court has heard.

A Goodna man violently pushed his ex-girlfriend and pinned her to the bed to the point where she felt like she couldn’t breathe after he was told to stop drinking, a court has heard.

Eldean Cole Blake, 37, pleaded guilty in district court at Beenleigh on Tuesday to common assault (domestic violence offence).

The court heard Blake unlawfully assaulted his ex-girlfriend at her family home in Loganholme after she asked him to stop drinking there and leave about 8.30am on March 14.

He had been in a relationship with the mother of three for over two years at the time and a domestic violence protection order was put in place for her benefit on December 9, 2019.

The complainant would often give consent for Blake to visit her family home on the condition that he did not consume alcohol there.

The court heard she had found his beers in the freezer and told him he could no longer drink there.

Blake started being abusive and said: “I can f***ing drink if I want to!”

He eventually agreed to leave and she went to retrieve some of her things from his car.

The complainant told Blake to stay outside and went back into the house and tried to close the door behind her but he forced his way inside.

Blake then followed her into the bedroom and refused to let her leave.

She tried to get out and he pushed her in the chest with both hands, sending her backwards into the wardrobe, before pushing her face a number of times and taunting her to hit him.

In an effort to get away, the complainant kicked him in the groin and he put his hand on her chest and pushed her back down onto the bed.

While he was holding her down, she felt like she couldn’t breathe, started to panic and pushed him off and kicked him in the groin again.

She managed to get out of the room, he followed and the police were called.

The ambulance later found red marks on her chest in the shape of a handprint and grab marks to her upper arms, scratch to her neck and upper back.

The court heard the woman’s three children were in the house but not the room at the time of the assault.

Judge Craig Chowdhury said Blake had a three-page criminal history of dated charges including assault occasioning bodily harm, public nuisance and enter premises by breaking.

“There’s a real problem with this sort of violence in our community … and often it’s committed when someone’s been drinking liquor,” he said.

The court heard Blake had served 139 days in custody between March 14 to July 30 while in remand and Judge Craig Chowdhury marked it as time served. No further punishment.
