A Logan man’s out of control behaviour towards a cop, where he swung at him with a haymaker during a torrent of abuse, has landed him a suspended jail sentence.

A Logan man’s out of control behaviour towards a policeman, in which he swung at him with a haymaker during a torrent of abuse, has landed him a suspended jail sentence.

Beenleigh Magistrates Court heard that on November 2 Daniel Mills punched and abused police officers on January 12 in Logan.

Mills, from Logan Central and Russell Island, was given a move-on notice and refused to leave, becoming verbally aggressive.

More officers were forced to attend and Mills began threatening them while squaring up.

“I’ll fight anyone who steps up on me,” he said.

Mills then went into the middle of the road, forcing cars to stop, before swinging a haymaker punch at an officer who tried to detain him.

An officer received a cut to his elbow in the attack.

As well, on May 6 in Torquay, Mills was pulled over by police and was found to be driving without a licence and also had cannabis in his system, the court heard.

Mills pleaded guilty to assaulting a police officer, public nuisance, driving without a licence, obstruct police officer and driving under the influence.

Defence lawyer Nicole Conlan accepted a jail term was justified but said actual custody was not necessary.

“Sending him to custody would be counter-productive to his rehabilitation and the community as a whole,” she said.

“He is remorseful and is making progress.”

Magistrate Mark Howden said Mills was lucky not to be placed behind bars.

“You’re extremely lucky you’re not going to jail today,” he said.

“You needed to be restrained by police and your traffic record is deplorable.

“If you drive without a licence, you will go to jail.”

Mills was sentenced to nine months’ prison, wholly suspended.

He was also fined $500 and his driving licence was disqualified for two years.
