A Logan business that was selling mini pinball machines online has been fined $30,000 for not providing what they promised.

Damian Leigh Holmes, 51, director of Mini Pinball Australia, was found guilty in Beenleigh Magistrates Court on May 31 of four counts of accepting money and failing to supply goods or services.

The court heard that between August, 2021 and August, 2022, Holmes failed to supply pinball machines to three customers in Beenleigh and Cairns.

In a victim impact statement tendered to the court, one of the victims said they now struggled to trust people online and suffered anxiety as a result.

The court heard the total amount owed to customers was $15,000.

It also heard Holmes had verbally coerced them into making the purchases.

An online message between Holmes and a victim was read out in court which detailed his abuse of a customer.

The message was sent after the company had gone bankrupt.

“F--k off c--k burn the company is liquidated,” Holmes said in the message read to the court.

Magistrate Tracy Mossop said that type of behaviour affected the community’s faith in purchasing items online.

“This offending affects consumers who try to purchase things online and quite frankly it’s despicable,” she said.

The court heard there was a lack of cooperation between Holmes and the prosecution.

He was fined $28,000 and a conviction was recorded.

Mini Pinball Australia was fined $30,000 and court costs of $240 were also ordered to be paid.

$15,000 of the fine was to be paid in compensation to the victims.
