A battle between two competing ice cream trucks at a Logan park got out of hand, when a Redlands man parked his rivals in and a fight ensued.
Christopher Paul McGuinness, owner of ice cream business Mr Yummy, arrived at Riverdale Park on a Sunday afternoon, June 30 to set up shop.
The 48-year-old Redland Bay man saw his rival ice cream truck company World of Swirls catering an event and parked them in.
Beenleigh Magistrates Court heard on Monday, October 16 that the World of Swirls owner filmed McGuinness blocking their van and in response he slapped the phone out of her hand.
He then pushed the woman over and threatened her while yelling not to take photos, before police arrived.
The victim suffered a scraped knee and her phone was smashed.
McGuinness pleaded guilty to assault occasioning bodily harm, wilful damage and public nuisance.
The court heard McGuinness had owned the business since 1993 and operated it alongside his brother, who was there on the day in question.
The pair were in competition with rival Capalaba-based business World of Swirls.
Senior police prosecutor Tim Wise said the fact the violence occurred in public and around families made it worse.
“Kids and families are there to enjoy their time and get ice cream,” he said.
“The defendant also has a previous conviction for violent behaviour in 2016.”
Magistrate Tracy Mossop said it was ridiculous behaviour.
“This was disgusting and despicable behaviour,” she said.
“Ice cream truck turf wars are completely unacceptable.”
He was fined $1200 and ordered to pay $600 in compensation to the victim.
No conviction was recorded.
