OUSTED Logan City CEO Sharon Kelsey has vowed to continue the fight to be reinstated after a court ruled today she was not allowed to return to the post before her unfair dismissal case is heard on July 30.

The Industrial Court today upheld an appeal by Division 8 councillor Cherie Dalley to bar Ms Kelsey from returning to work.

The court also ruled out wage maintenance for Ms Kelsey whose pay was reinstated by the Appeal Court in May.

Ms Kelsey did not dwell on the setback but said she was looking forward to the full hearing, which is set down for next month.

Today’s decision overturned a May 4 Queensland Industrial Relations Commission decision to reinstate Ms Kelsey while she awaits her July 30 QIRC hearing.

Cr Dalley, appointed Logan City Acting Mayor last month after Mayor Luke Smith was stood aside, lodged her appeal on May 11.

The Industrial Court delayed the hearing for a week and the findings were handed down this morning.
