A drunken, shirtless Logan man draped in a flag who yelled at police “Aussie Aussie Aussie, it’s my right” is back in court again.

Brock Thomas Franklin appeared in Beenleigh Magistrates Court on Thursday, January 25 for choking his ex-partner in Waterford.

During his appearance for that matter, the court heard Franklin was no stranger to the law and was arrested on Australia Day in 2011 after police noticed he was drunk and behaving aggressively in a crowd.

Franklin yelled at police, accused them of bashing him and had to be restrained, the court heard.

He was shirtless, wearing an Australian flag and shouted at police: “F--k them, Aussie Aussie Aussie. It’s f-----g Australia Day, it’s my right.”

He pleaded guilty in Southport Magistrates to public nuisance and obstructing a police officer in relation to the incident, the court heard.

He received a $600 fine and no conviction was recorded.

The court also was told details of his latest arrest, which came after a heated argument with his ex-partner on December 11 in 2022.

The 31-year-old Acacia Ridge man pleaded guilty to one count of common assault over the incident.

The court heard Franklin began recording the woman on his phone while she was smoking cannabis and then grabbed her by the throat for five seconds.

Judge Craig Chowdhury said Franklin’s behaviour in the 2011 Australia Day was unacceptable but he had had a fairly unremarkable criminal history since then.

“You behaved like an idiot on Australia Day but have no history of violence before today,” he said.

“Whatever situation you find yourself in, it is never appropriate to resort to violence.”

Franklin had already served 68 days of pre-sentence custody so he was convicted but not further punished for the assault.

A conviction was recorded.
