A young Logan landscaper has landed on the wrong side of the law after a clash with his neighbour “got out of control” and he attacked them with a piece of timber.

Anthony Adam Johnston, 27, pleaded guilty in Beenleigh Magistrates Court on Monday to one count of assault occasioning bodily harm while armed and one count of wilful damage.

Police prosecutor Sergeant Donna Cole told the court Johnston armed himself with a piece of timber and went to confront his neighbour after his mother came home upset one day following a dispute with them.

“Upon approaching the victim, he threw a punch at him and as a result of that he hit the victim with the wood and then chased him down the street,” she said.

“He then claimed after a physical altercation he hit the victim only once more with the wood before picking up his phone and smashing it on the roadway and then walking away and damaging the victim’s car.”

The neighbour was taken to hospital for a hairline fracture and was left with $1300 worth of property damage.

Johnston’s lawyer said his client had no prior criminal convictions and the incident was out of character for him.

He said Johnston became very upset after learning his neighbour had reached into his parent’s car and touched his mother.

“He is deeply sorry for what he did and he realises he went overboard with that,” he said.

Magistrate Kilner said while he acknowledged there was definitely some provocation, Johnston reacted excessively in the circumstances.

He was sentenced to complete 70 hours of community service and ordered to pay $1300 in restitution. No conviction was recorded.
