Murder charges against Issac Zane Cubby expected to move to higher court in five weeks

The man charged over the death of Robert Brown had his case mentioned in the Toowoomba Magistrates Court and the final steps are being taken for it be finalised.

The case against a Toowoomba man charged with murder arising from the death of 75-year-old photographer Robert Brown is set to move to the Supreme Court in the coming weeks.

Issac Zane Cubby had his matter briefly mentioned in the Toowoomba Magistrates Court on Thursday where Legal Aid solicitor Phil Stainton asked for a short adjournment to review some of the police evidence.

Mr Stainton told the court his office had recently taken the matter over from another Toowoomba firm but had some minor issues with the brief of evidence.

“Some of the material was unable to be accessed so we had to get new copies,” he said.

It is expected the matter will proceed to a registry committee (at the next occasion).

Magistrate Kyna Morice adjourned the matter to May 29.

Mr Cubby has been in custody since his arrest in February, 2023.

Police allege he was one of several males who attended Grand Central Shopping Centre on February 6, 2023 while in a stolen vehicle.

One of the males, who was aged 17 at the time, exited the vehicle, ran up behind Mr Brown and pushed him over before stealing his bag.

Mr Brown suffered catastrophic head and neck injuries and could not be revived.

He died in hospital about a week later.

The boy was initially charged with murder but pleaded guilty to the alternative charge of manslaughter in the Toowoomba Supreme Court on April 8.

He turned 18 while in pre-sentence custody but cannot be named because he was a minor at the time of the offence.

His matter will be brought back to the Supreme Court for sentencing on Friday.

Mr Cubby has not been required to enter a plea.
