Robert Brown death: Three teens now face murder charge

After a review of the autopsy results, detectives have upgraded the charges levelled against three teenagers over 75-year-old Robert Brown’s death.

Issac Cubby, 18, and two co-accused teens have had their charges upgraded from grievous bodily harm to murder as detectives continue their investigation into the death of Robert Brown.

The upgraded charges come four days after Mr Brown died from injuries he suffered when he was pushed over while waiting for a taxi on Margaret Street, in the heart of Toowoomba’s CBD.

Police allege that at about 5.10pm on February 6, Mr Cubby exited a stolen Hyundai Tucson that was parked in Dent Street, ran up behind Mr Brown and pushed him over before stealing his backpack.

Mr Brown fell forward off the pavement and onto the street, landing on his head.

The impact left the 75-year-old photographer with critical neck and head injuries from which he would never recover.

He died in the Toowoomba Hospital on February 13.

Polair and police tracked an allegedly stolen Tucson after the incident and intercepted it on Hermitage Road at 8.40pm the same day.

The two occupants left the scene on foot and were tracked by the Dog Squad.

Mr Cubby, a 17-year-old Dalby boy and a 17-year-old Harlaxton boy who were all initially charged over the incident, have today had their charges upgraded to murder.

Mr Cubby will reappear in Toowoomba Magistrates Court on Tuesday, March 28.

The 17-year-old boys have been remanded in custody and will appear in the Toowoomba Childrens Court at a later date.
