Teen applies for bail in Toowoomba Magistrates Court after alleged drug dealer beaten, robbed at Drayton

A teen alleged to have been involved in a drug deal gone wrong, which resulted in a man being beaten with a bat, has applied for bail. Here’s what happened in court.

A court was been told an alleged violent robbery that occurred near Wuth Street Park in Drayton, was not a random attack, but a drug deal gone wrong.

At 12.30am on Tuesday morning, March 14, a man and woman reported to police they were robbed by four men who approached their parked car with a baseball bat.

One of the men was wearing a mask.

The rear window of the victim’s car was allegedly smashed in and the man was allegedly hit in the head with the bat, and he also may have a fractured elbow.

Soon after the incident, police arrested two men, Jose De Oliveira Silva and Frazad Goli, after tracing the alleged offender’s car to Mr Goli’s home address.

The court was told Mr Goli,18, and Mr De Oliveira, 20, were found at the house with the victim’s phone, the baseball bat, and masks.

Mr Goli was charged with assault causing bodily harm while armed in company, attempted robbery with violence while armed in company, entering a premise to commit an indictable offence, and possessing a drug pipe or utensil.

Mr De Oliveira Silva was charged with assault causing bodily harm while armed in company, attempted robbery with violence while armed in company, and entering a premises to commit an indictable offence.

Legal Aid Queensland solicitor Phil Statham told the court Mr Goli said the victims were not innocent bystanders, but alleged drug dealers who had reneged on a deal.

Mr Statham said the two groups arranged to meet, but things turned violent after the alleged victim did not provide cannabis that had been paid for by the alleged offenders.

Mr Statham submitted that if Mr Goli had strict bail conditions, his risk to the victim and community could be mitigated, and noted the teen had full-time work and the drugs were not for him.

Police prosecutor Kinsley Weir said Mr Goli was on bail at the time of the alleged robbery and he was too much of a risk to the community to be given bail.

Magistrate Louise Shephard agreed with police and refused to grant Mr Goli bail.

The co-accused, Mr De Oliveira Silva, remained in the watch house when his matters were mentioned in court on Wednesday, March 15, and his solicitor Alyshia Jacobsen told the court her client was not required.

She said Mr De Olveira Silva was on a return to prison warrant and so no application for bail would not be made at this stage.

Ms Shephard remanded Mr De Oliveira Silva and Mr Goli in custody and adjourned both cases to May 3, for a mention.

A brief of evidence was also ordered.
