‘Stupid mistake’ lands young in Toowoomba tradie in court

A young civil construction worker has been handed a lifeline in court after police caught him over the limit on a midnight cruise.

On October 3, Xavier William Cattle fronted Toowoomba Magistrate Court for driving over the limit.

A young Toowoomba tradesman with a sparkling traffic history was handed a lifeline in court after he was caught driving over the limit at Westbrook.

Civil construction trainee Xavier William Cattle, 21, successfully applied for a work licence at the Toowoomba Magistrates Court on Tuesday, October 3, after pleading guilty to driving over the general alcohol limit.

On October 3, Xavier William Cattle fronted Toowoomba Magistrate Court for driving over the limit.

The court heard when Cattle was intercepted by police at 11.11pm on Friday, August 18, he told officers there was no reason to breathalyse him because he knew he was over the limit.

Police prosecutor Jessica Lynch said Cattle had two other passengers and recorded a reading of .099.

Mr Cattle represented himself at court, telling the magistrate he had made a ‘stupid’ mistake.

Magistrate Clare Kelly told the young man he had put his life at risk and the lives of his passengers as well as other road users.

Ms Kelly approved Cattle’s application for a work licence, noting he would not be able to work without it, which would put him at extreme risk of financial hardship.

She noted police did not oppose the work licence, and there were no previous entries on Cattle’s traffic history.

His licence was suspended for two months and he was fined $450.

No conviction was recorded.
