A Pooraka man has admitted to causing a hit and run collision that left a man fighting for life, in a bizarre love triangle situation.

Dylan Penney, 27, was due to face sentencing submissions in the District Court on Thursday but his lawyer asked for an adjournment to obtain a psychological report.

The court heard the psychologist wanted to do further neurological testing on Penney and obtain records relating to a serious assault he suffered.

During Penney’s successful bail application, the court heard he was disqualified from driving when he hit a 57-year-old Barossa man about 2.20am on October 31, 2021.

A prosecutor alleged Penney was “out stalking” his ex partner who was with her new boyfriend, when he hit him and another man at a Chesser St property at Parafield Gardens.

“There’s a suggestion the defendant was outside the house in his vehicle, the two men have gone outside and the defendant put his high beams on and drives at them, he mounted the pavement and onto the kerb,” the prosecutor said.

The court heard Penney then left the scene.

“Police examined his vehicle and it was covered in bleach on the front grill where he’d tried to remove debris,” the prosecutor said.

The court heard the boyfriend escaped serious injury, while the second man had to be resuscitated at the scene and suffered serious injuries including a fractured skull, neck, ribs and pelvis and internal bleeding.

Penney’s defence lawyer Alex Panousakis told the court at the time the prosecution’s case was a “misapprehension” and “factually incorrect”.

Mr Panousakis said the man who was hit was the partner of Penney’s ex-girlfriend’s mother, who had come to the address at the ex-girlfriend’s request.

He said she had altered her police statement to say Penney had sought her out.

On Thursday, Judge Nick Alexandrides “reluctantly” adjourned Penney’s charges until July, saying the pace of the proceedings had been as “slow as a wet week”.

Two victim impact statements will be read on the next occasion.
