A Pooraka man was “out stalking” his ex partner when he allegedly caused a hit and run leaving a man fighting for life before trying to destroy the evidence, a court has heard.

Dylan Penney, 24, drove towards his ex-partner’s new boyfriend, hit another man, fled the scene and later poured bleach on the front of his car, a court has heard.

The scaffolder applied for bail via video link at the Elizabeth Magistrates Court on Monday after being charged with causing serious harm, causing harm by dangerous driving, and leaving the scene of an accident after causing harm.

Police Prosecutor Andrew Haynes told Magistrate Brian Nitschke Penney was already disqualified from driving when he hit the 57 year old Barossa man at around 2.20am on October 31.

Mr Haynes alleged Penney was “out stalking” his ex partner who was with her new boyfriend.

The accused drove his vehicle towards the new boyfriend and another man at a Chesser St property at Parafield Gardens, the court heard.

“He was out in his car trying to locate her, sending text messages to her,” Mr Haynes said.

“There’s a suggestion the defendant was outside the house in his vehicle, the two men have gone outside and the defendant put his high beams on and drives at them, he mounted the pavement and onto the kerb.”

The court heard, Penney who has outstanding matters including aggravated assault and driving disqualified, then allegedly left the scene.

“Police examined his vehicle and it was covered in bleach on the front grill where he’d tried to remove debris,” Mr Haynes said.

While both men were allegedly hit, the boyfriend escaped serious injury.

Mr Haynes said the second man had to be resuscitated at the scene and suffered serious injuries including a fractured skull, neck, ribs and pelvis but internal bleeding.

He remains in the Royal Adelaide Hospital in a stable condition.

Penney’s defence lawyer Alex Panousakis told the court the prosecution’s case was a “misapprehension and is factually incorrect”.

Mr Panousakis said the man who was hit was Penney’s ex girlfriend’s mother’s partner who had come to the address at the ex-girlfriend’s request.

He said she had altered her police statement to say the accused had sought her out.

“In my submission, the versions of events are almost irreconcilable,” he said

Magistrate Nitschke said despite the witness’ change of position the charges were serious.

“We still have a man who drives off doesn’t go to the police, and is alleged to be tampering with evidence the next day,” Mr Nitschke said.

Penney was released on home detention bail and will face the Adelaide Magistrates Court in June.
