‘Third and final chance’ for child rapist guilty of breaching sex offender registry 20+ times

A Toowoomba man on a suspended jail term for the rape of two children has been re-sentenced for the vile crime after he was involved in stealing cars and breaking into homes.

A Toowoomba man who was found guilty of raping two children when he was a teenager has been re-sentenced for the vile crime after he was caught committing a raft of property offences while high on drugs.

Despite Queensland legislation changes allowing publications to name rapists, the man cannot be named because he committed the crime when he was 16-years-old.

The Toowoomba District Court heard the man, who is in his 30s, was placed on a two-year jail term, suspended for two years, after he was found guilty of two counts of rape before a different jurisdiction in 2022.

After the child sex offender was found guilty of the historic rape at a trial, he entered eight pleas of guilty to the indecent treatment of a child under the age of 12.

The court heard since being placed on the suspended sentence, the man had breached the order more than 20 times by failing to comply with his reporting obligations as a sex offender.

More than a handful of the breaches related to the unemployed man having contact with children, some of which related to a partner’s child, and the friends of that child.

However the man fronted the Toowoomba District Court on Wednesday, October 9, for breaching the sentence by committing a raft of drug fuelled property offences including break and enter, unlawful use, and willful damage.

When he pleaded guilty to the property crimes before the Toowoomba Magistrates Court in September, he was sentenced to complete 120 hours of community service after the 35 days he spent in pre-sentence custody was taken into account.

The court heard the man had not committed any crimes since April, which coincided with his admission into a live-in rehabilitation facility that had successfully kept him clean of drugs and alcohol.

When he was dealt with for the latest breach of the suspended rape sentence, Judge John Allen KC told the man his successful rehabilitation efforts over the past five months were critical to the sentence.

Judge Allen warned the man it was his third and final chance, and the next time he breached the suspended sentence he could expect to serve time behind bars.

Again, the operational period of the man’s suspended sentence was extended by six months.

The man’s jail term was set to expire in January 2025, however it will now end on July 28, 2025.
