A Whitsunday magistrate has blasted a local handyman for “peeing everywhere” in a jail cell at the end of an Airlie Beach drinking bender.
Martin Dale Pataczek, 35, was locked up at the Whitsunday watch-house when he used mattresses in his cell to block the view of CCTV cameras, then urinated on the door and floor.
Proserpine Magistrates Court heard police arrested Pataczek for being a public nuisance in the main street about 12.15am on October 2 and put him in a cell equipped with a toilet for his personal use.
Police prosecutor Sergeant Emma Myors said he left the cell smelling of urine and it had to be forensically cleaned.
Pataczek told the court he “went off the rails” that night and had been drinking “everything under the sun” because of family issues.
“I found out I’ve got a daughter – she’s 16 now – I found out she existed about three years ago,” he told the court.
“I’ve been trying to build a relationship with my daughter but I was cut off by the mother.”
Magistrate James Morton fined Pataczek $500, with a conviction recorded, and told him his actions would only give the mother more reasons to keep his daughter away from him.
“This is what I see from young teenagers – getting drunk, spewing in the cells, sh---ing themselves,” Mr Morton said.
“You’re 35 years of age, intentionally you’ve peed everywhere – unless you’re a cat, you’ve got no excuse.”
