Cyrus James Hankin faces court over Proserpine car window smash

A court heard it was lucky the young father didn’t do more damage when he stopped traffic in Proserpine to smash a stranger’s car windows. See the pictures.

An 18 year old who launched a terrifying random attack on two women in Proserpine had an opportunity to receive anger management counselling several weeks prior, a court has heard.

Cyrus James Hankin was drunk on rum when he walked into the middle of Renwick Road about 4.40pm on August 15, stopped two women travelling in a Mitsubishi Triton, and proceeded to headbutt the stationary car’s driver’s side front window so hard he left blood on the glass.

As the driver started to accelerate to get away, Hankin smashed the driver’s side rear window with both fists, leaving glass all over the back seat and the car’s owner with a $320 repair bill.

Police found an agitated Hankin walking along Fuljames Street later that afternoon and arrested him on charges of public nuisance and wilful damage, adding an obstruct police charge when he resisted their attempts to load him into a paddy wagon.

At Proserpine Magistrates Court on Monday, Aboriginal and Torres Strait Islander Legal Service barrister Phillip Moore said his client was “more than embarrassed” about his behaviour, which he attributed to “extreme” stress about an upcoming meeting about a family issue.

“He doesn’t work, he has a 10-month-old child who he cares for with the assistance of his mother,” Mr Moore explained.

Mr Moore said the meeting concerned Hankin’s parenting arrangements and Hankin was worried he might not be able to see his child.

“Ultimately, that meeting went well.”

Mr Moore said it had been recommended to Hankin that he complete an anger management counselling course two weeks before the incident as people “saw that he was stressed”.

He had since commenced the fortnightly course, Mr Moore said, and expressed a desire to compensate his victims as he accepted his actions would have been “extremely upsetting”.

“It’s been a wake up call for him,” Mr Moore said.

Magistrate James Morton described Hankin’s offending as “very odd” and told him he was lucky the driver had not run him over as a “guy standing in the street with fuzzy hair, angry and drunk”.

“You know what’s the first thing people think? They put a colour to things. It’s a terrible, terrible way of thinking but that’s what happens,” Mr Morton said.

“You’re lucky this was two women – you might’ve got two blokes get out of the car and give you a flogging.”

The sentence was a $450 fine plus a $320 restitution order.

No convictions were recorded.
