‘Obviously you don’t know who I am’: A guard had asked the man to move back because of COVID distancing rules.

A former Magnums employee has faced court after assaulting one of the popular Airlie pub’s security guards.

Cody Lee Hayes was standing in line to enter the venue in August with two women and the guard asked the group to move back from the people lined up in front because of COVID distancing rules.

Police prosecutor Senior Constable Sarah Rowe told Proserpine Magistrates Court on Monday Hayes became argumentative and told the guard, “you obviously don’t know who I am”.

Sen-Constable Rowe said the guard tried to call for back-up but Hayes grabbed the man’s hand and the microphone, so the guard could not make the call.

The guard tried to remove Hayes’ hand and a struggle ensued, ending when Hayes fell into a garden.

Hayes left the scene and the guard did not suffer any injuries.

On Monday, Hayes pleaded guilty to common assault.

Lawyer Elizabeth Smith, acting for Hayes, said the victim had previously denied the 28-year-old Cannonvale man entry to the pub and Hayes had been waiting outside for about 45 minutes.

The court heard Hayes put his hand on the guard’s hand so they could continue having a conversation.

Ms Smith said Hayes, who is a labourer, had previously worked at Magnums so he knew the staff there well.

Magistrate James Morton fined Hayes $350 and banned him from Magnums for a year.

No conviction was recorded.

“This man is obviously doing his job, calling for back-up,” Mr Morton said.

“It is not on.”
