23-year-old Whitsunday mother makes bail bid amid DV assault charges

A mother accused of repeatedly assaulting her ex-partner and his mother in different locations across Queensland amid custody arguments has asked to be released on bail once again.

A mother accused of repeatedly assaulting her ex-partner and his mother in different locations across Queensland amid custody arguments, has asked to be released on bail once again.

The 23-year-old mum, who cannot be named for legal reasons, has pleaded not guilty to a total of 10 charges that involve different sets of domestic violence order breaches, and assaults occasioning bodily harm in a domestic relationship.

Magistrate Michelle Howard read the different charges that started from April 15 to May 13 in front of the Proserpine Magistrates Court.

Between April 15 to April 25, the mother is accused of having breached a DV order made against her by her ex-partner and father of her child in December 2023.

She is also accused of assaulting him occasioning injuries on two occasions between those dates, once in Caloundra and once in Coolum Beach.

On May 10, she allegedly breached a DV order and assaulted the same partner this time at a location in West Mackay.

On May 13, she allegedly breached a DV order and assaulted that same partner in Proserpine.

On the same day she is also accused of assaulting her ex partner’s mother.

She pleaded not guilty to all charges.

ATSILS solicitor Philip Moore made a second bail application for the mum, who had already spent five weeks in custody, claiming that her circumstances had changed now that she was pleading ‘not guilty’.

He said the case would now face further delays in order to produce a full brief for a hearing.

Mr Moore also asked the court to consider that the offences had occurred in the context of her children being taken in the state’s care.

He also told the court she had already secured accommodation in Proserpine.

Prosecutor Sergeant Emma Myors said she agreed the case would be delayed if it went to a hearing, but that prosecution would keep opposing her release.

She told the court her acts of violence had been persistent and always against the same person, and that her release would put the welfare of her ex-partner at risk.

Magistrate Michelle Howard granted the woman bail.

She told her the conditions of her release would be very strict, with no contact with her ex-partner and his mother and the obligation to report once a week.

The case will be next mentioned on September 30.
