Toneil Alice Mills faces Warwick Magistrates Court on wilful damage, assault occasioning bodily harm, common assault

A Warwick mum has been labelled as ‘pathetic’ after details of her assault on two women and a car on Christmas Day last year were exposed in court.

A Warwick woman’s behaviour has been labelled by a magistrate as “pathetic and appalling” following details of her “unjustified and nasty” assault on two people, and a car, which resulted in more than $6000 in damages.

Toneil Alice Mills pleaded guilty in Warwick Magistrates Court on Monday, March 11 to one charge each of assault occasioning bodily harm while in company, wilful damage and common assault

All three charges relate to an incident that took place on December 25, 2023.

The court was told that at an address in Warwick, in which another group of people were socialising and having drinks, Mills and her partner and four others, including co-accused Amber Louise May Lambert, arrived at the house and “immediately began making upsetting and derogatory comments to people present”.

Following a scuffle between two other guests, the partner of Mills approached a partygoer and said something akin to “you have been running your mouth, Toneil get in here and bash this slut”.

“Instead of saying no to that stupid idea, you ran to the victim and said ‘are you running your mouth’ and grabbed her by her hair, pushed her head down before punching her face,” magistrate Virginia Sturgess detailed.

The victim blocked 10 of Mills’ punches with her hands, which showed the woman had a “very concerted attempt to assault the woman” before letting her go.

Several partygoers had tried to get Mills and her group to leave the address, when Mills turned to another woman calling her a “fat s--t” and saying “what about this fat s--t talking s--t?”

The woman tried to move away from Mills, but her partner blocked her in, before Mills pulled her by her hair and punched her “six or seven times” in the face.

As a result of Mills’ assault, the woman had injuries to her eyes, immediately feeling swelling and was later hospitalised.

After leaving the property, Mills turned her anger onto a victim’s vehicle, kicking the driver’s side of the car multiple times, causing damage to multiple panels of the vehicle and breaking the mirror.

The damage was quoted at $6198.54, the court was told.

The 35-year-old mum of two’s offending was “out of character”, defence lawyer Hamish Chapman submitted.

Ms Sturgess reacted to the detail by saying she was “absolutely lost for words” and said she was “well and truly old enough to know better”.

“I honestly don’t know what gets into your head to think this is a good idea to go out and treat people in this way,” Ms Sturgess told the woman.

“It’s quite pathetic.”

Ms Sturgess said there was no excuse for the offending, and that “whatever background you might think you have with these people is no excuse”.

“I’m absolutely lost for words, I don’t know what gets into your head to think this is something that you should go out and do one night, pick a fight, name call and physically assault people who clearly don’t want to have a fight with you – and then cause substantial damage to the victim’s motor vehicle.

“Frankly this is appalling, pathetic behaviour for a 35-year-old who ought to know better.”

Mills was sentenced to a two year probation order, with no convictions recorded.

In the same court Mills’ co-accused Lambert was sentenced to a 12 month probation order, with no conviction was recorded.
