A Moffat Beach grandfather has avoided more jail time after he strangled a woman multiple times and sexually assaulted her.
Troy Neil Anderson, now 57, was sentenced to five years’ prison released on parole immediately after already serving 351 days in presentence custody.
Maroochydore District Court heard Anderson threatened to distribute compromising photos or recordings of a woman on March 5, 2020.
The next day Anderson pushed the woman over, strangled her at least six times while he called her names and yelled at her to open her legs.
Judge Long said Anderson was holding a TV remote and demanded the woman open her legs saying, “We are going to start with something small like the remote and then we are going to finish with a 40mm spanner”.
“The complainant described she could not breathe or speak … (Anderson) maintained pressure on her throat and pushed the TV remote against her genitals,” Judge Long said.
Anderson then proceeded to knee her in the head and told her she was going to die.
He ripped her dress off and undressed himself, rubbing his genitals on her and pushing his fingers against her anus.
Judge Long said Anderson wrapped a towel around her throat, pulling it so tight that she could not breathe and lost consciousness.
The victim regained consciousness when Anderson slapped her thigh before tying her up.
There were later incidents where Anderson picked up the woman by the throat and threw her to the ground, brandished a knife, punched her in the head and said “I’m going to take you out to the bush and bury you”.
“This was obviously a sequence of harrowing experiences for the complainant and has had some significant psychological impacts,” Judge Long told the court.
Reading her impact statement in court, the victim said the pain from being physically and sexually assaulted by Anderson was never not with her.
“Your hands around my throat are never not with me … each day I experience the trauma,” she said.
Defence barrister Greg McGuire said his client had two children and three grandchildren and had worked in the building industry as a qualified carpenter.
Mr McGuire said Anderson was addicted to ice at the time of the offending and had a work accident where his foot was crushed.
Anderson pleaded guilty to two counts of strangulation, six counts of common assault, two counts of sexual assault, three counts of threatening violence, threats to distribute intimate image or recording, deprivation of liberty and assault occasioning bodily harm.
