A Belli Park machine operator claims he doesn’t remember punching a security guard and scratching another’s face for no apparent reason during a night out in Maroochydore.

Timothy Royce Tredwell of Belli Park, 29, was ordered to pay $500 compensation and complete 150 hours’ community service within one year in Maroochydore Magistrates Court on September 13, 2022.

The court heard Tredwell had been out drinking with his friends for a birthday event on March 27, 2022, when he approached the line at Sol Bar and for “no reason” punched a male security guard.

Another female security guard then attempted to restrain Tredwell.

Magistrate Richard Lehmann said Tredwell struck the woman to the face causing a “substantial” scratch that bled.

“You then grabbed her by the hair and pulled hard and aggressively, refusing to let go,” Magistrate Lehmann said.

“She suffered a whiplash type injury and had to get a CT scan and had to have three days off work.”

Magistrate Lehmann said she also sustained injuries to her knee, numerous bruises, ongoing headaches and had to get some massage therapy.

“She now feels more worried going to work that she will be assaulted and it has affected her confidence,” he said.

Duty lawyer Katie Patterson said her client had no recollection of the incident due to his level of intoxication.

Ms Patterson said while the offending was serious it was “extremely out of character” for Tredwell.

“He has no prior criminal history … whilst it’s accepted that he drunk to excess on this particular occasion we reject the assertion that he has issues with alcohol that would require ongoing intervention,” Ms Patterson told the court.

“He has not returned to Ocean St since the night of this offending.

“He is extremely disappointed in himself for his conduct that night and remorseful for the injuries sustained.”

Tredwell wrote a letter of apology and the court heard he had been taking care of his father who was hospitalised.

He pleaded guilty to assault occasioning bodily harm, common assault and drunk and disorderly.

No convictions were recorded.
