Vivienne Mary Glover appeals stalking conviction

A 71-year-old Noosaville woman who allegedly stalked her neighbours for more than a decade in what was described as never ending intimidation has successfully appealed her conviction.

A 71-year-old Noosaville woman who was jailed for allegedly stalking her neighbours for more than a decade has had her guilty verdicts quashed.

Vivienne Mary Glover successfully appealed her three-year jail conviction she received in Maroochydore District Court on November 18, 2021 following a marathon eight-day trial.

Ms Glover pleaded not guilty to two counts of stalking the couple between November 30, 2008 and February 28, 2019 in Noosaville.

She was accused in court of fantastical accusations that the pair were involved in drug trafficking and rape during what was described as never-ending intimidation and harassment that “petrified” the couple.

The 71-year-old appealed her conviction on the grounds the indictment was duplicitous, the judge failed to adequately direct the jury on evidence and the judge misdirected the jury about the application of the criminal code.

Court of Appeal documents revealed there had been a miscarriage of justice with the 71-year-old Noosaville woman’s conviction successfully appealed on April 8, 2022.

Her verdicts were quashed with a retrial expected for each count.

Crown prosecutor Alex Stark did not oppose Ms Glover’s application for bail in Maroochydore District Court on Tuesday.

Defence barrister Simone Bain said the restraining order between Ms Glover and the alleged victim couple she received at her sentence would still be in place.

Ms Bain said there would be a submission made on a retrial due to the amount of time Ms Glover spent in jail after her sentence.

During the eight-day trial the court heard from several witnesses who said that Glover allegedly took several photos and recordings of the couple going about their daily lives.

Defence barrister Simone Bain said the Crown had painted a one-sided picture that described Glover as a “super villain” and benefited the alleged victim who also had 700 journal logs about Glover.

While finishing his case before the jury, crown prosecutor Alex Stark said Glover’s accusations of rape and drug crimes went beyond a neighbourhood dispute.

Judge Gary Long granted Ms Glover bail on Tuesday and adjourned her mention to the next call-over on June 8, 2022.
