Footage has been shown to a magistrate of an alleged bashing at a Sunshine Coast bottle shop which spilled in from the street following a minor car accident.
It was only four seconds however the footage of a local BWS liquor shop allegedly captured the moment Timothy Robert Josephy Williams attack two alleged victims on Wednesday following a car crash in Mooloolaba.
Police prosecutor Mel Pyke said the alleged melee began at this traffic incident where it was claimed the unemployed 35-year-old rear ended the two victims on Tuesday.
Sergeant Pyke said the two people who had their vehicle hit exited the car and took a photo of Williams’ vehicle.
Police allege Williams approached a victim with a knife and threatened to kill them.
The police prosecutor alleged a victim ran to a nearby BWS and asked the store clerk to lock the store and call 000.
Sergeant Pyke alleged the other victim was still at the vehicle when Williams approached them at arms’ length and threatened to stab them with a 25cm knife if the photos were not deleted.
Police further alleged Williams took the keys out of the victims’ car’s ignition and said “this is my car now”.
Williams then allegedly made his way to the BWS with the keys where both victims retreated to.
The court was told the 35-year-old allegedly struck one of the victims in the head who fell to the floor before Williams rained down more blows “with force”.
He allegedly assaulted the second victim, which prompted one of them to strike Williams over the head with a wine bottle in self defence.
The court was told Williams allegedly left the two men with the parting words of “if I ever see you again I’ll cut your throat”.
Police were able to track Williams a short distance away at his home where they allegedly found the vehicle involved along with two knives inside.
He was arrested and charged with three counts of threatening violence and one of common assault, assault and robbery. He appeared in Maroochydore Magistrates Magistrates Court on Wednesday where he applied for his release.
Sergeant Pyke showed CCTV footage of part of the alleged assaults to magistrate Raelene Ellis and said identification of Williams was “very solid”.
She claimed the case was strong due to him being identified with the vehicle where weapons were allegedly found, and objected to his bail due to a concern by police Williams would either commit more crimes or fail to come to court.
Defence lawyer Luke Bull said Williams could abide by strict conditions and claimed the 35-year-old had no reason to flee the state due to his four children going to school on the Sunshine Coast.
He stated the strength of the case against the Mooloolaba man was “questionable”, and was instructed the alleged victims in fact allegedly approached the 35-year-old’s vehicle with a gel blaster or gun.
Mr Bull said it was contested that Williams was the aggressor and asked the 35-year-old to show the court while on video from the watch-house a wound above his ear which he received when he was hit with a wine bottle.
He said the alleged incident outside the bottle shop would be his version against the two others and claimed the keys to their vehicle were not found when Williams was arrested.
In her bail decision, Ms Ellis recounted offences of violence in Williams’ history as well as his bail breaches, and believed he still posed a risk to the community.
The Mooloolaba man’s bail was refused. His matter will return to court on September 1 and no pleas have been entered.
