Sunshine Coast court hears Beau Gregory Tapscott’s bail application

A man on drugs charges told the Maroochydore Magistrates Court he would go straight into rehab if released from prison on bail.

Australia's growing drug crisis

A man who police claim was in possession of up to 18.9g of methylamphetamine applied for bail in the Maroochydore Magistrates Court on June 16, 2022.

Beau Gregory Tapscott, 39, who is in custody, appeared in the Maroochydore Courthouse via video link with supporters including his mum in the courtroom.

Tapscott was charged with one count of possessing dangerous drugs schedule one drug quantity of or exceeding schedule three but less than schedule four; once count of fail to properly dispose of a needle or syringe and one count of possessing anything used in the commission of crime.

Duty lawyer Michael Robinson said Tapscott could live with a family friend if he was granted bail and he could report to police frequently.

“In relation to those drug offences, there’s an allegation that he’s in possession of 18.9g, including the bag, of methylamphetamine, however we don’t have any information as to the relative purity or otherwise of that methylamphetamine,” Mr Robinson said.

“Without the benefit of a brief or a certificate of analysis, we just don’t know and that might take some six months to procure that brief.”

Police prosecutor Lee Allan said the weight in relation to the drugs was excessive.

“While my friend has identified that may not be the case at the end of the day, there is a risk there will be a significant weight attributed to that gross weight that’s been located by police,” he said.

He also said the defendant, a Noosaville man, was on a suspended sentence at the time of the alleged offending.

“There are some breach of bail offences previously recorded,” the police prosecutor said.

Tapscott also addressed Magistrate Barry Barrett directly and said he would go straight into drug rehabilitation if he was released.

The police prosecutor said there were issues with the defendant’s vaccination status that meant entry into rehabilitation was complicated.

“I’d be going to get my vaccinations, the first one tomorrow, and I’d be trying to get myself into a rehab facility,” Tapscott said.

“I’ve never done rehab before.”

Magistrate Barrett refused the bail application.

He said the defendant had a poor history in relation to bail matters.

“He has a history of failing to abide by bail conditions,” Magistrate Barrett said.

Tapscott was remanded in custody until July 14, 2022, for the next court appearance via video link.
