A Nirimba father and business owner has appeared in court after he allegedly pulled a pistol on a group of strangers and then held the weapon to someone’s head.
Peter Matthew Dati, 34, fronted Maroochydore Magistrates Court on November 28 via videolink from the Maroochydore Watch House, where he applied for bail.
He is charged with assault occasioning bodily harm while adversely affected by an intoxicating substance, two charges of dangerous conduct with a weapon, driving under the influence, driving unlicensed, possessing tainted property and possessing dangerous drugs.
The court was told Mr Dati and an associate had allegedly gotten into a fight with a group of strangers at the Ocean St nightclub strip on Sunday night and allegedly struck a man in the face.
Witnesses followed Mr Dati and the other person to a car park and had their phones out when he tried to get into a car, which Magistrate Matthew McLaughlin said was likely to take photos for evidence.
Mr McLaughlin said Mr Dati was then alleged to have pulled a silver revolver pistol on the group and threatened them before “poking” one person in the head with the weapon and threatening to shoot them.
Mr Dati and the other person then left the scene, but were later tracked down by police and found with approximately 6.5g of cocaine and $2500 in cash.
The alleged weapon remains missing, but police later found six rounds of 38 calibre ammunition at the car park crime scene.
The court was told Mr Dati appeared intoxicated when he was arrested.
Duty lawyer Leisel Rogan said Mr Dati owned a family carpentry business with his brothers and had recently bought a house in Nirimba, where he lives with his wife and two young children.
Mr McLaughlin said there was no evidence to suggest Mr Dati was involved in organised crime, and the alleged events happened in an “unplanned way”.
Mr Dati was granted bail on the condition he not approach any of the alleged witnesses, and was banned from the Maroochydore Safe Night Precinct on Ocean Street.
He will return to Maroochydore Magistrates Court on January 27, 2023, for committal mention.
