A man who sent his probation officer dirty text messages and phoned her to tell her how he was sexually preoccupied has been sentenced to jail with immediate probation.

Oliver Brady Alcorn, 34, of Cooroy pleaded guilty to using a carriage service to menace, harass or cause offence, among other charges, in Noosa Magistrates Court on July 12, 2022.

Police prosecutor Sergeant Alison Johnstone said the defendant had phoned a senior case manager for community corrections on January 19, 2022, and told her he was sexually preoccupied and that he had his hands down his pants while he was speaking to her.

The defendant usually reported to the probation officer.

Sergeant Johnstone said Alcorn then sent his probation officer text messages that included references to wanting an extra set of hands and masturbating.

“These text messages and phone call made her feel quite uncomfortable,” she said.

It was among a number of other charges Alcorn pleaded guilty to, including wilful exposure.

The police prosecutor asked for a six to nine-month prison term to serve one-third.

Legal Aid lawyer Liesel Rogan asked for a six-month prison term for her client and an immediate release on parole.

The lawyer said the wilful exposure charge occurred after the defendant was masturbating in his own bedroom with the curtains drawn, but could still be seen by the public.

She said her defendant had previously engaged with a psychologist and was willing to continue the sessions.

Ms Rogan said her defendant had chromosomal abnormalities and a brain defect as a baby, had anxiety and depression and a long-standing history with drugs.

For the wilful exposure charge, Magistrate Haydn Stjernqvist fined Alcorn $800 and recorded a conviction.

For the misuse of a carriage service charge, Alcorn was convicted and sentenced to nine months in prison, immediately suspended, and entered into a $1000 recognisance and a good behaviour period of three years.

The defendant was also convicted and fined on other charges.

Magistrate Stjernqvist said he did not impose actual imprisonment because psychological authorities had stated that a period of actual incarceration would be more difficult for the defendant than someone who was more well-adjusted.
