A Noosaville man accused of attempted murder and dangerous driving after he allegedly struck two cyclists with his car in September 2021 is still waiting to have his mental health assessed.

Kyle John Heaney, 23, is charged with attempted murder, three counts of dangerous operation of a vehicle, committing a public nuisance, failing to remain at the incident and render assistance as a driver and obstructing a police officer.

Police will allege Mr Heaney was driving when he allegedly struck semi-professional cyclist Daniel Di Domenico who was riding along Frizzo Rd, Palmwoods on September 30, 2021.

Police will allege one of Mr Di Domenico’s riding colleagues was also struck by Mr Heaney in a separate incident along Nambour Connection Rd, Nambour.

Mr Heaney allegedly left the scene of the Nambour crash before continuing to drive, leaving the victim with a serious head injury.

It is alleged Mr Heaney was later involved in a third crash at Burnside.

Mr Heaney fled into a dam and police had to wade into the water to arrest him.

Police will allege all three incidents occurred about an hour apart.

Defence lawyer Luke Bull represented Mr Heaney in Maroochydore Magistrates Court on June 17, 2022, and said he was still waiting to receive a mental health assessment report for his client.

“I’ve chased it up a number of times now,” Mr Bull said.

“One report has been completed but I haven’t received it and now I’ve been told there’s an addendum report and this week I chased it up and still haven’t received that.”

Magistrate Matthew McLaughlin said his court documents showed a chief psychiatrist’s report was requested in December 2021.

“It’s such an awful situation because if he is found unsound and in the meantime he’s been locked up in jail and he’s mentally incompetent, then that’s terrible,” Mr McLaughlin said.

“I know there’s nothing I can do about it but I’m sure the Mental Health Court people are snowed under but it’s a terrible situation that someone who is potentially not deserving of any punishment is locked up in jail and been there for eight months.

“All we can do is just keep waiting for the report to arrive.”

Mr Bull indicated to the court that if the report returns soon then he will assess whether a bail application for Mr Heaney is appropriate.

The matter was adjourned to July 15 for further mention.
